The Food Safety and Standards Authority of India (FSSAI) has issued nine notices to Swiggy Instamart over consumer complaints alleging the delivery of expired, spoiled, rotten and contaminated food. Two of the flagged products belong to NOICE, Swiggy’s own private label.

FSSAI said NOICE eggs were marketed under a brand name not covered by the product categories approved under the platform’s existing licence. It directed the Food Business Operator (FBO) to stop marketing the product unless it is covered under a valid licence, and to apply for a licence modification if required. Separately, the regulator flagged NOICE Homestyle Madras Mixture with Peanuts for allegedly being supplied after its expiry date.

Swiggy launched NOICE on Instamart in August 2025 as its in-house label. Marketed by Scootsy Logistics, a Swiggy subsidiary, the brand spans more than 200 products across 13 categories, including eggs, bread, and paneer. This makes Swiggy the FBO for the flagged products directly, with no third-party seller to absorb liability.

What else did FSSAI flag? The notices cite alleged violations under the Food Safety and Standards (FSS) Act, 2006, across product quality, licensing and grievance redressal:

  • Infant food: An infant food formulation reached a consumer in a highly deteriorated condition, showing signs of contamination and improper storage. Instamart allegedly re-supplied the same product after the consumer returned the defective item.
  • Expired stock: Healthify 100% Whey Protein (1 kg) allegedly reached consumers after its expiry date, alongside the NOICE Madras Mixture.
  • Contaminated products: Akshayakalpa Organic Eggs allegedly arrived rotten and emitting a foul odour, with no corrective action despite escalation. A Kakke da Paratha allegedly arrived spoiled and unfit for consumption. Complaints also alleged contaminated eggs and milk, as well as damaged packaged food.
  • Licensing gaps: The notices flag incorrect, invalid, or non-existent licence numbers, as well as entities allegedly listed under names different from those on their FSSAI registration.
  • Grievance failures: Some consumers reported receiving no response or corrective action despite escalation. In one case, Instamart allegedly offered only a refund without addressing the food safety concern.

FSSAI also raised concerns over seller onboarding, compliance verification, traceability and food quality monitoring.
