The Supreme Court refused to quash the First Information Report (FIR) filed against Bhojpuri folk singer Neha Singh Rathore. Earlier in April, the Uttar Pradesh police had registered a complaint over her posts criticising the government’s handling of the Pahalgam terror attack. The Supreme Court Justices J.K. Maheshwari and Vijay Bishnoi said the SC was “not inclined to intervene at this stage,” allowing the trial to proceed. The justices clarified that this wasn’t a comment on the merits of the case and advised Rathore to contest specific charges during the trial.
Since both the Allahabad High Court and the Supreme Court refused to quash her FIR, Rathore will now face trial. She faces charges under Section 69A of the Information Technology (IT) Act and multiple provisions of the Bharatiya Nyaya Sanhita (BNS), including offences related to affecting India’s sovereignty and calling for mutiny. More critically, the trial will test whether the virality of a citizen’s posts can justify criminal prosecution.
Context of the Neha Singh Rathore Tweets in the Case
Neha Singh Rathore, a folk singer known for her political commentary, posted a series of tweets on X (formerly Twitter) after the Pahalgam terror attack. The posts questioned the government’s priorities and political motivations in the backdrop of a national crisis. The Allahabad High Court judgment, which the Supreme Court has now let stand, reproduces several of her tweets verbatim.
In one, she suggested the Prime Minister was using the tragedy for political gain:
“कश्मीर में आतंकी हमला हुआ और उसके फ़ौरन बाद मोदीजी ने आज बिहार में रैली कर दी… ताकि बिहार की जनता से राष्ट्रवाद के नाम पर वोट बटोरा जा सके…”
In another, she claimed the ruling party was diverting attention from its own failures by advocating for war:
“आतंकवादियों को ढूँढने और अपनी गलती मानने की बजाय भाजपा देश को युद्ध में झोंकना चाहती है… भाजपा देश के हज़ारों सैनिकों की जान जोखिम में डालना चाहती है।”
In a third post, she questioned whether the media had adopted the narrative of a religious divide under pressure:
“जब कलमा पढ़ने से इनकार करने पर गोली मार ही दी गई तो ये किस्सा मीडिया को किसने बताया? … वो मत सोचिए जो भाजपा चाहती है।”
