If X disagrees that a piece of content is unlawful, the remedy is not to challenge Rule 3(1)(d) of the IT Rules, 2021 but to challenge the law that makes the content unlawful, Solicitor General Tushar Mehta said during a hearing at the Karnataka High Court on July 18. This comes as part of the ongoing lawsuit between X and the Indian government, where the company is contesting takedown notices issued under Section 79(3)(b) of the IT Act (and Rule 3(1)(d)) via the Sahyog Portal.
